It might help if you edit the bone solid first. Make a Plane and create a clean cut at the top to remove the rounded edges. You can use Pull to move the top of the bone up some until it rises above the top of the foot.
Do the same for the foot solid. Having one end of the bone solid cleanly rise about the foot solid may help the Boolean operation to succeed.
